This writ petition is filed for a mandamus to direct the respondent to appoint the petitioner in the post of Lab Assistant /Lab Attender.
2. According to the petitioner, she has been selected through the District Employment Exchange, Coimbatore and has been appointed as Sweeper in the sanctioned vacancy. While so, the Government had issued G.O.Ms.No.277 dated 30.10.2012 granting permission to fill up 4393 sanctioned posts of Lab Assistants and out of which as per G.O.Ms.No.151 dated 07.08.2013, 70 posts were available in the Coimbatore District. According to the petitioner, two modes have been prescribed for recruitment, one is promotion from Record Clerks having 3 years experience and another is by way of appointment by transfer of persons belong to the School Department in the Tamil Nadu Basic Service having S.S.L.C. qualification.
3. It is the claim of the petitioner that since she is having S.S.L.C qualification and coming under the Tamil Nadu Basic Service working in the post of Sweeper, as per the Government Order, she is entitled to be appointed to the post of Lab Attender/Lab Assistant. 2/4

Today, when the writ petition was taken up for hearing, the learned Government Advocate by submitting the proceedings of the respondent in Na.Ka.No.2074/A1/2020 dated 23.04.2021 submitted that at the time of filing of the writ petition, the petitioner was not eligible to be considered, but however subsequently on attaining the eligibility, the case of the petitioner has been duly considered and the petitioner has been appointed in the post of Record Clerk. Since the petitioner has already been appointed by considering her service, the relief sought for in the writ petition has become infructuous.
5. The learned counsel appearing for the petitioner, on instructions, confirms this position and submits that the same may be recorded and the writ petition may be closed.
In view of the same, this writ petition stands disposed of recording the stated position. Consequently, the connected miscellaneous petition is closed. No costs.
