By consent, the Writ Petition is taken up and disposed of at the admission stage itself.

2. The present writ petition has been filed to issue a writ of mandamus directing the first and second respondents to consider the representation dated 18.11.2024 made by the petitioner and pass appropriate orders within stipulated time.

3. It is the case of the petitioner that he is the member of the 5th respondent society for the past several years. The petitioner had borrowed a tractor loan for a sum of Rs.11,58,000/- for which, he had paid his member share of Rs.1,10,000/- and it was waived during the year 2016 and after the said loan amount was waived by the State Government Page No.2 of 6

Policy and without any intimation to himself the Secretary of the society, the fifth respondent has deducted member share amount of Rs.80,675/- towards bogus crop loan in his name during the year 2017.

4. The learned counsel appearing for the petitioner submitted that he has given a representation dated 18.11.2014 to the respondents 1 to 3 to take appropriate action against the fifth respondent working as secretary in the society. Hence, the petitioner has been filed the present writ petition.

5. The learned Government Advocate appearing for the respondents 1 to 3 submitted that pursuant to the representation given by the petitioner dated 18.11.2024 , the third respondent has issued summon on 01.02.2025 and the same was received by the petitioner on 03.02.2025 for the enquiry which is fixed on 12.02.2025. He further submitted that three months time is required for enquiry proceedings.

6. Heard the learned counsel appearing on either side and also perused the materials available on records.

In view of the submissions made by the learned counsel on either side, the second respondent is directed to consider the representation of the petitioner dated 18.11.2024, after giving due notice to the petitioner as well as the interested parties, affording opportunity of personal hearing, on merits, in accordance with law and pass appropriate orders, within a period of three months from the date of receipt of a copy of this order.

8. This writ petition stands disposed of with the above direction. No costs.
