PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the 2nd respondent to consider and dispose of the petitioner's statutory representation dated 01.12.2025 seeking victim compensation under Section 396 of the Bharatiya Nagarik Suraksha Sanhita, 2023, read with the Puducherry Victim Assistance Scheme, 2012, in the light of the facts pleaded, the findings of the Trial Court in C.C.No.104 of 2023, and the binding judgments of the Supreme Court and this Court, within a time frame to be fixed by this Court and consequently, to grant appropriate victim compensation commensurate with the petitioner's proven loss and pass such further orders.

ORDER

This Writ Petition has been filed seeking a direction to the 2nd respondent to consider and dispose of the petitioner's statutory representation dated 01.12.2025, seeking victim compensation under Section 396 of the Bharatiya Nagarik Suraksha Sanhita, 2023, read with the Puducherry Victim Assistance Scheme, 2012, in the light of the facts pleaded, the findings of the Trial Court in C.C.No.104 of 2023, and the binding judgments of the Supreme Court and this Court, and consequently, to grant appropriate victim compensation commensurate with the petitioner's proven loss and for further orders.

2.The case of the petitioner is that she is the victim of crime committed by the 4th respondent. The 3rd respondent had filed the final report, based on which, trial was conducted in C.C.No.104 of 2023 on the file of the learned Chief Judicial Magistrate, Puducherry and the 4th respondent was found guilty. The learned Chief Judicial Magistrate, Puducherry, while convicting the accused, had directed the accused to pay the compensation of Rs.10,00,000/- to the victim and hence, the petitioner sent a representation to the respondents 1 and 2 on 01.12.2025 seeking victim compensation. However, the petitioner's statutory representation dated 01.12.2025 has not been considered. Hence, the present Writ Petition has been filed.

3.The learned Public Prosecutor appearing for the respondents 1 to 3 would submit that the petitioner's representation had been taken up for consideration and the petitioner was directed to appear before the District Legal Services Authority, Puducherry, on 13.12.2025. He would further submit that due enquiry would be conducted and appropriate orders will be passed on the representation of the petitioner dated 01.12.2025 by the 2nd respondent.

4.Recording the submission of the learned Public Prosecutor appearing for the respondents 1 to 3, this Writ Petition (Criminal) is disposed of, with a direction to the 2nd respondent to dispose of the statutory representation made by the petitioner dated 01.12.2025 and to pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
