Respondent PRAYER: Originally this petition has been filed as Original Application No.5791 of 2002 before the Tamilnadu Administrative Tribunal at Chennai and after abolition of TNAT, petition has been transferred and numbered as W.P.No.5868 of 2007. Writ petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to call for the records relating to the Panel of Junior Inspectors as on 01.05.2001 issued by the respondent in Na.Ka.No.69061/2002 Pa.Tho-1 dated 31.08.2002 and direct the respondent to include the name of the applicant in the said panel at the appropriate place with reference to his seniority and grant him all consequential benefits including promotion as Junior Inspector with effect from the date of promotion of his immediate junior. O R D E R

This Writ Petition has been filed challenging the order relating to the Panel of Junior Inspectors as on 01.05.2001 passed by the respondent dated 31.08.2002 issued in Na.Ka.No.69061/2002 Pa.Tho-1 and direct the respondent to include the name of the applicant in the said panel at the appropriate place with reference to his seniority and grant him all consequential benefits including promotion as Junior Inspector with effect from the date of promotion of his immediate junior.

2.When the matter was taken up today, none appeared on behalf of the petitioner.

3. The learned Special Government Pleader (Co-op) for the respondent would submit that though the petitioner has filed this Writ Petition before this Court, he has opted to remain in Steno Typist line for being promoted as Grade II and I respectively and relinquished his promotion on 01.05.2016 in the panel for being promoted as Junior Inspector and still remains as Steno Typist. Therefore, the relief sought for by the petitioner in the Writ Petition has been granted by the Government and hence nothing survives for further adjudication in this Writ Petition.

4.Considering the submission made by the learned Special Government Pleader (Co-op) stating that nothing survives for further adjudication in this Writ Petition, this Writ Petition is liable to be dismissed as infructuous.
