A/525/2020 in CS/7/2018 A.No.525 of 2020 in C.S.No.7 of 2018 N.SESHASAYEE. J., The suit is laid in 2018 for recovery of a sum of Rs.9.41 Crores with interest at 18%. In this case, the defendants were set ex-parte for not filing the written statement on 12.11.2019 and the present Application was laid to set aside the ex-parte order. This Court on 04.08.2021 required the defendants to file their written statement but, it was not filed. When the matter came up before this Court on 17.09.2021, this Court specifically directed the defendants to file their written statement but, on payment of cost of Rs.5,000/- for delaying it and the case is again posted today. 2.The learned counsel for the defendants submitted that the written statement could not be filed.
3.The institution of Courts is created only to provide an audience to the parties in order they resolve their dispute. However, this Court spots a defendant who does not seem to take the Court and the objective for which it is established seriously and seems to treat it as some kind of casino. https://www.mhc.tn.gov.in/judis/
