This second appeal is directed as against the judgment and decree dated 20.10.2004 in A.S.No.80 of 2002 on the file of the Principal Subordinate Court, Tindivanam, confirming the judgment and decree dated 21.10.2002 in O.S.No.270 of 1996 on the file of the Principal District Munsif Court, Tindivanam

2. On an earlier occasion, the learned counsel for the appellant endorsed and submitted that though registered post was sent to the appellant it was returned as refused and also https://hcservices.ecourts.gov.in/hcservices/

submitted no instruction from the appellant. Therefore, the appellant's name was printed in the cause list. Even then, today the appellant did not appear in person or through counsel, which shows that the appellant is not interested to proceed with this second appeal further.

3.Therefore, the Second Appeal is dismissed for non-prosecution. Consequently, connected miscellaneous petition is closed. No costs.
