Dpm / PR-26 / 2018 dated 20.06.2018, ii) Na.Ka.No. F1 / PR-26 / 2018, dated 29.06.2018, iii) Na.Ka.No.
08 / PR-26 / 2018, dated 20.09.2019, iv) Na.Ka.No. 09 / DSP. Dpm / PR-26 / 2018 dated 03.10.2019, and v) Na.Ka.No. F1 / PR-26 / 2018, dated 21.01.2020 passed by the 2nd respondent, quash the same, consequently, directing the respondents to defer the departmental proceedings in P.R No. 26/2018 dated 14.05.2018 till the conclusion of the criminal case in Spl.S.C. No.15 of 2018 on the file of the Learned Sessions Judge Fast Track Mahila Court, Erode in WP.NO.2151 OF 2020.
Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.N.MANOHARAN, Advocate for the petitioner the court made the following order:- https://hcservices.ecourts.gov.in/hcservices/
While disposing of this Writ Petition on 30.01.2020, this Court directed the petitioner to participate in the departmental proceedings before the 2nd respondent and cross-examine the witnesses and submit his defence. The 2nd respondent can proceed further with the enquiry. Let there not be any final orders passed in the departmental proceedings till the criminal case gets over. Till that stage, all the other formalities can be completed. In the meantime, there shall also be a direction to the learned Sessions Judge - Fast Track Mahila Court, Erode, to complete the trial in Spl.S.C.No.15 of 2018 and pass final judgment within a period of eight weeks from the date of receipt of copy of the said order.
2. This Court has received a communication from the Sessions Judge, Magalir Neethi Mandram, (Fast Track Mahila Court), Erode seeking extension of time to comply with the order dated 30.01.2020 passed in the above Writ Petition. The learned Judge has expressed certain genuine difficulties for not complying with the orders of this Court within time.
3. Therefore, time is extended by 15 days from today to comply with the order dated 30.01.2020 passed by this Court in the above Writ Petition.
