Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents 1 to 2/police to provide adequate police protection to the petitioner and his family members to cultivate the land in Survey No.239/4 measuring 1.46 hectares, and as per new sub division Survey No.239/4A measuring 0.40.5 hectare, situated at Thiyagarasanapalli Village, Shoolagiri Taluk, Krishnagiri District, on the basis of the petitioner's complaint dated 26.11.2025.

ORDER

This Writ Petition has been filed for direction directing the first respondent to provide police protection to cultivate the land comprised in Survey No.239/4 measuring 1.46 hectares, and as per new sub division Survey No.239/4A measuring 0.40.5 hectare, situated at Thiyagarasanapalli Village, Shoolagiri Taluk, Krishnagiri District on the basis of the petitioner's complaint dated 26.11.2025. 2.

Heard the learned counsel appearing on either side and perused the materials placed before this Court.

It is seen from the records and also on the submissions made by the learned counsel appearing on either side, it is revealed that the subject property has been purchased by the petitioner and his brother jointly by the registered sale deed dated 29.06.2024 from one Prakash vide registered document No.4257 of 2024. The said Prakash purchased the subject property from one Suseela by the registered sale deed vide document No.8299 of 2023 dated 01.12.2023. The subject property originally owned by the respondents 3 to 5 and they entered into agreement for sale with Suseela and subsequently, the subject property was sold out in her favour by the registered sale deed dated 03.02.2014 vide document No. 341 of 2014.

Thereafter, the respondents 3 to 5 herein had filed a suit in O.S.No.214 of 2019 on the file of the Sub Court, Hosur, as against the said Suseela. Subsequently, the said suit was also dismissed for default on 24.02.2022. Now the respondents 3 to 5 filed petition to restore the suit with condone delay petition and it is pending. Further the respondents 3 to 5 herein are claiming possession and enjoyment of the subject property. But on the other hand, the petitioner is also claiming possession and enjoyment of the property by virtue of sale deed dated 29.06.2024.

Considering the facts and circumstances, the request made by the petitioner seeking police protection to cultivate the property cannot be granted. However, the petitioner is at liberty to approach the civil Court for appropriate relief in the manner known to law. 6.

With the above directions, the Writ Petition stands disposed of. There shall be no order as to cost.
