This writ petition has been filed challenging the order passed by the respondent under Section 6 of the Tamilnadu Land Encroachment Act.

2.Mr.V.Ramana Reddy, learned counsel for the petitioner would urge that the land in dispute does not belong to Public Works Department and by G.O.Ms.No.1582, Labour (Housing), the land has been assigned in favour of the Slum Clearance Board. It is also contended that the civil suit filed by the association in O.S.No.4053 of 1994 on the file of the XVI Assistant City Civil Court, Chennai, has been decreed. 3.Per contra, Mr.I.Sathish, Additional Government Pleader stated that under Section 10 of the Land Acquisition Act, the petitioner can prefer an appeal. When an effective alternative remedy is available, the petitioners cannot approach the Court directly invoking Article 226 of the Constitution of India. 4.I find force in the submissions of the learned Additional Government Pleader. It is not disputed that the petitioners are having effective alternative remedy. Without exhausting the same, the present writ petition is filed.
5.Accordingly, this writ petition is dismissed as not maintainable. No costs. Consequently, connected miscellaneous petition is closed.
