(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 379 & 430 of IPC r/w Section 21(5) of Mines and Minerals (Development & Regulation) Act, 1957 r/w Section 3 of TN Public Property (Prevention of Damage & Loss) Act, 1992 in Crime No.2123 of 2020 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is said to have transported one unit of river sand by using Tata 407 van without any valid licence. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. Therefore, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that there are three previous cases pending against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and also the antecedents of the petitioner are reported to be bad, this Court is not inclined to grant anticipatory bail to the petitioner.
