JUDGMENT

Today, when the matter is taken up for hearing, there is no representation for the appellants.

2.It is seen from the records that the third respondent is no more and till date no steps have been taken by the appellants to implead the legal heirs of the deceased third respondent. The Second Appeal is of the year 2005 and hence, I do not find any reason to keep the appeal pending.

3. In view of the same, this Second Appeal is dismissed for non prosecution. No costs.
