PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent to dispose of the appeal petition dated 15.02.2021 filed by him, on merits within the time frame filed by this Hon'ble Court.

Mr.TNC Kaushik, learned Additional Government Pleader accepts notice for R1 and R2 and is armed with instructions to proceed finally. In view of the order that is proposed to be passed in this Writ Petition, no notice is thought necessary to R3. Hence, by consent of both sides, this Writ Petition is disposed finally even at the stage of admission.

2. The petitioner seeks a Writ of Mandamus directing the 1st respondent/ District Collector to dispose of Appeal Petition dated 15.02.2021 filed by him.

3. Mr.Kaushik would confirm that the appeal is pending before R1 and the same would be disposed in accordance with law within the time frame fixed by this Court.

4. Thus, the mandamus as sought for is issued and R1 is directed to dispose the appeal dated 15.02.2021 filed by the petitioner, after hearing R3 as well as any other parties who may be thought fit and necessary for the proper adjudication of appeal, within a period of eight (8) weeks from today.

5. This Writ Petition is disposed with the aforesaid direction. No costs.
