O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 22(b) r/w 8(c) of NDPS Act, 1985, in Crime No.269 of 2025 on the file of the respondent Police, seeks anticipatory bail.

The allegation against this petitioner is that, the petitioner was found in possession of 39 grams of metamphetamine in his house and therefore, he was arrested and remanded to judicial custody on 06.12.2025. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and quantity alleged is an intermittent quantity of contraband; and that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that recovery of 39 grams of Metamphetamine is done in the house of the petitioner, that the investigation of this case is pending.

Considering the submissions made on both sides and perused the materials available on record.

Considering the facts and circumstances of this case, gravity of offence, though the quantity involved is intermediate, the petitioner has one previous case of similar nature, if the petitioner is granted anticipatory bail, then there is a likelihood of involving in offences similar in nature and taking note of the fact that the petitioner is arrested recently and the investigation of the case is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
