PRAYER: The Criminal Original Petition is filed under Section 482 of the Criminal Procedure Code, pleased to direct the respondent to expedite the trial in C.C.No.70 of 2018 on the file of the learned Additional Mahila Magistrate Court, Salem. For Petitioner :

O R D E R

The Criminal Original Petition has been filed to direct the respondent to expedite the trial in C.C.No.70 of 2018 on the file of the learned Additional Mahila Magistrate Court, Salem.

2. Learned counsel for the petitioner would submit that based on the complaint given by the petitioner, a case in Crime No.7 of 2012 was registered by the respondent against the accused, who is the petitioner's husband and mother in law. Though the case is of the year 2012, the respondent completed investigation and filed the final report during the year of 2014 and the case was taken up for trial during the year of 2018 in C.C.No.70 of 2018. The trial was moving in snail pace and that only the examination of PW1 to PW3 were completed on 05.11.2020 and thereafter, there is no progress in the trial. Due to which, the present petition has been filed seeking to direct the trial Judge, Additional Mahila Magistrate Court, Salem to expedite the trial and deliver judgment.

3. Learned Government Advocate (Crl.Side) would submit that the examination of PW1 to PW3 have been completed on 05.11.2020 and the case was posted for examination of witnesses LW 2,5 & 6 on 10.02.2022. However, on that day, the witnesses have not been examined.

4. Heard the submissions made by both the counsels and perused the materials available on record.

In view of the fact, though the FIR is of the year 2012, the final report has been filed during the year of 2014 and the case has been taken up in the year 2018, this Court directs the learned Additional Mahila Magistrate Court, Salem to complete the trial and dispose the case in C.C.No.70 of 2018 as expeditiously as possible within a period of three months from the date of receipt of a copy of this order.

6. With the above direction, the Criminal Original Petition is disposed of.
