ORDER
By consent, this writ petition is taken up for final disposal.
2. This Writ Petition is filed for a Mandamus directing the respondents 2 and 3 to grant victim compensation amount as per Section 357A(4) Cr.PC by considering the application of the petitioner dated 05.01.2026 within a time frame.
3. The case of the petitioner is that when he and his family gone to attend a function at his mother-in-law's house, his house was broke open and jewels worth about Rs.12,50,000/- and cash of Rs.15,000/- were stolen. Based on his complaint, a criminal case was registered on 05.08.2016, but till date, the accused were not traced and final report is yet to be filed. The petitioner has
relied upon the orders passed in Crl.O.P.No.10290/2025 dated 25.11.2025 and Crl.O.P.No.22051/2025 dated 03.09.2025 to emphasis that the State is bound to pay victim compensation equivalent to 30% of the value of the property reported stolen. The petitioner has also submitted a representation dated 05.01.2026 to the respondents 2 and 3 praying for victim compensation under Section 396(4) of the BNSS, 2023, however his representation was not considered till date and hence, he has come up with the present writ petition.
4. Heard both sides and perused the materials on record.
5. Considering the limited prayer sought for, this Court, without going into the merits of the case, directs the 3rd respondent to consider and dispose of the petitioner's representation dated 05.01.2026 and pass appropriate orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. No costs.
