O R D E R
(The Order of the Court was made by M.JAICHANDREN J.,) This Habeas Corpus Petition has been filed praying that this Court may be pleased to direct the respondent to produce the body of the detenu, namely, Janakiraman, who is the husband of the petitioner, before this Court and set him at liberty.
2. It has been stated that the detenu had left his house and his whereabouts is not known. Therefore, the petitioner had lodged a complaint before the Vyasarpadi Police Station, the respondent herein, on 24.9.2015. The said complaint had been registered, as CSR No.372 of 2015. However, as no action had been taken, by the respondent Police, to trace the detenu, the petitioner has preferred the present Habeas Corpus Petition before this Court.
3. At this stage of the hearing of the Habeas Corpus Petition, the learned Additional Public Prosecutor appearing for https://hcservices.ecourts.gov.in/hcservices/
the respondent had submitted that serious steps had been taken to trace the detenu. He had further submitted that the detenu had eloped with one Saraswathi.
4. In view of the submissions made by the learned Additional Public Prosecutor appearing on behalf of the respondent, we are of the view that no further orders are necessary in the present Habeas Corpus Petition, at this stage. However, the first respondent Police shall continue with the investigation to trace the detenu and to take necessary steps, in accordance with law. Hence, the Habeas Corpus Petition stands closed.
