O R D E R

Head Mr.K.M.Ramesh, learned counsel for the petitioner and Mr.Ravindran, learned senior counsel appearing on behalf of Mr.L.Swaminathan, learned counsel representing respondent/contemner.

2.It is submitted by the learned senior counsel for the respondent that the erstwhile Regional DirectorOperations Mr.S.Baskar, retired from service on 31.03.2018 and the Regional Director-Operations is lying vacant since the date of his retirement. Dr.M.R.Prakaash, who is the Chief Executive Officer of the respondent is present before this Court. In the affidavit filed by the respondent / contemner, an unconditional apology has been tendered. The contemner, namely the Chief Executive Officer of the respondent has concluded the affidavit by tendering an apology in Paragraph No.9 for non-payment of Rs.3500/- per month commencing from December 2017 to May 2018. Further the Chief Executive Officer has undertaken that no lapse would recur in future and the administration of the Medical College would be effecting the payment of Rs.3500/- without any default till the disposal of the main writ petition.

3. Since arrears have been paid and there is a specific undertaking given by the respondent/contemner in the affidavit dated 25.07.2018, the same is placed on record and the contempt petition is closed and the personal appearance of the Chief Executive Officer is dispensed with.
