PRAYER: The Writ Petition has been filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, to call for the records of the order of transfer dated 23.07.2008 in proceedings in Na.Ka.2/ 28817/2008 on the file of the first respondent and quash the same.

The present Writ Petition has been filed for the issuance of a Writ of Certiorari, to call for the records of the order of transfer dated 23.07.2008 in proceedings in Na.Ka.2/ 28817/2008 on the file of the first respondent and quash the same.

2. The petitioner was transferred on the ground of surplus teacher on 23.07.2008. However, on 28.07.2008, one Pitchan was posted as Secondary Grade Teacher for the same surplus post. Considering the same, this Court has granted stay on 16.09.2008.

3. Now that 13 years have passed. The situation may be different. Therefore, the first respondent is directed to consider as to whether the petitioner can continue in the same post on the strength of the stay order granted by this Court on 16.09.2008 or the petitioner needs to be transferred. After considering all these aspects, the first respondent is directed to pass fresh order within a period of four (4) weeks from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
