ORDER

This writ petition has been filed challenging the proceedings of the nd respondent dated 29.09.2023 and for a consequential direction to the 2 nd respondent to restore the document registered as document No.595 of 2006 and 8651, 8652 and 8653 of 2014 and to cancel the subsequent documents that were

registered as document No.6710 of 2024 and 6755 of 2024 on the file of the 3 rd respondent touching upon the suit property.

Heard Mr.N.R.Anantha Rama Krishnan, learned counsel for the petitioner and Mr.P.Harish, learned Governemnt Advocate for respondents 1 to 3.

The proceedings dated 29.09.2023 was issued by the 2 nd respondent purportedly in exercise of powers under Section 77A of the Registration Act. The Division Bench of this Court in [M. Kathirvel Vs. The Inspector General of Registration Department of Registration and Others] reported in 2024 4 CTC 769 has now held that Section 77A of the Registration Act is unconstitutional. In view of the same, the proceedings of the 2 nd respondent dated 29.09.2023 must be held to be non est in the eye of law. As a consequence, the cancellation of the documents registered as document No.595 of 2006 and 8651, 8652 and 8653 of 2014 must be held to be bad and these documents will stand restored. In view of the same, the execution of the subsequent documents which was registered in document No.6170 of 2024 and 6755 of 2024 on the file of the 3 rd respondent touching upon the same subject properties will become questionable. Hence, it is left open to the private respondents 4 to 10 to work out their remedy before the competent Civil Court in the manner known to law.
