Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of certiorarified mandamus calling for the records of the first respondent, relating to the award dated 11.12.2002 passed in I.D.No.124/2001 and quash the portion of the award denying the reinstatement, continuity of service and backwages to the petitioner and thereby, direct the 2nd respondent to reinstate the petitioner into service with continuity of service and backwages and to pay a sum of Rs.35,000/- as compensation as ordered by the first respondent. 1/4

When the matter was called on earlier two occasions viz., 07.06.2022 & 27.06.2022, there was no representation for the petitioner. Hence, the matter was directed to be listed under the caption, "For Dismissal" on 01.07.2022.

2. Today (05.07.2022), this case is listed under the caption, "For Dismissal". Even today, there is no representation for the petitioner. However, the learned counsel for the second respondent is present. This shows that the petitioner is not interested in prosecuting the case. Hence, this Court has no other option, except to dismiss this petition for nonprosecution. Accordingly, this writ petition is dismissed for nonprosecution. No costs. Consequently, connected miscellaneous petition is closed.
