ORDER

Mr.V.Meghanathan, learned Government Advocate (Criminal Side) takes notice on behalf of the respondent.

2. This Criminal Original Petition has been filed, to direct the respondent to give police protection to the petitioner and his family members based on the petitioner's representation dated 02.01.2022.

3. The learned counsel for the petitioner would submit that the petitioner had purchased the property (Agricultural Land) which is comprised in Survey Nos.113/13, 113/15 measuring about 40 Ares (Equal to 1 Acre) by a Sale Deed from Radha, W/o.Kathirvel and Sandhiya, W/o.Palani during the year 2013 vide

Doc.No.4008 of 2013 registered at the Office of the SubRegistrar, Sankarapuram and the petitioner is in possession of the property.

4. It is the case of the petitioner that one Shanmugam, S/o.Muthupillai along with one Selvaraj, S/o.Ramalingam, Velu, S/o.Poovathu Udaiyar, Poikunam, Poosari, Ramalingam trespassed in to the property of the petitioner and prevented him from cultivating in his land.

5. It is further case of the petitioner that the revenue documents namely Patta, Chitta, Adangal of all stands in the name of the petitioner. It is further case of the petitioner that Shanmugam and few other persons joined together and disturbed his possession, thereby, the petitioner has given a complaint to the respondent police on 02.01.2022 seeking police protection. However, the respondent police has not given any police protection to him. Hence, the present petition has been filed seeking police protection.

The learned Government Advocate (Criminal Side) would submit that on the complaint dated 02.01.2022, the petitioner has stated that the counter party also claims title over the property and the respondent police finding that there were frequent quarrels and skirmishes between the parties and finding that the dispute concerning property was likely to cause breach of peace, has referred the matter to the RDO, Salem District in proceeding No.2 of 2022 dated 07.02.2022. He would further submit that the matter is pending before the RDO for enquiry and the respondent will be able to proceed further only after the outcome of the RDO enquiry.

7. Recording the same, this Criminal Original Petition stands closed.
