Mr.G.Elanchezhiyan Prayer : Writ Appeal under Clause 15 of the Letters Patent against the order passed in W.P.No.5981 of 2001 dated 11.08.2010. This Writ Petition filed under Article 226 of the constitution of India praying for the issuance of a writ of certiorari to call for the records of the 1st Respondent relating to the claim petition No.7638/97 and quash the order dated 27.10.2000.
JUDGMENT
(Judgment of the Court was delivered by T.S.SIVAGNANAM, J.) Heard Mr.Anand Gopalan, learned counsel for the appellant, Mr.R.P.Prathap Singh, learned Government Advocate for the first respondent and Mr.Elanchezhian, learned counsel for the some of the other respondents.
2. Due to the subsequent development, the challenge to the impugned order passed in the writ petition has become infructuous, since, on remand, the Inspector of Labour has passed fresh orders, which has been challenged by the appellant / management by filing a writ petition. It is further submitted that the respondent workmen had raised an industrial dispute, which was dismissed, as against which the respondent workmen have filed a writ petition and the same is also pending. Therefore, we close this appeal, leaving it open to both the
parties to canvass all the grounds in the writ petitions and any observation in the impugned order in this appeal will not affect the rights of the parties. The appeal is closed. No costs.
