S.Sandeep Kumar v. The Inspector Of Police,

RMT.TEEKAA RAMAN,J., The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 406, 420, 498(A) and 506(i) of I.P.C and Section 4 of Dowry Prohibition Act, in Crime No.10 of 2023, seeks anticipatory bail. This is the second bail application.

2. The learned counsel for the petitioner submitted that the petitioner is an innocent person. He has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

3. Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) for the respondent police and perused the materials available on record.

4. It is stated that the matter was referred to Tamil Nadu Mediation and Conciliation Centre and the same is failed. H.M.O.P.No.88 of 2023 is pending before this Court. The earlier bail application No.17283 of 2023 dated 09.08.2023, this Court was inclined to grant the anticipatory bail for A2, A3 and A4 and as against this petitioner who is the husband petition was dismissed.

It is further stated that the prime allegation in the complaint is that the wife has sold the property for a sum of Rs.1,60,25,000/- and handed over the entire money to her husband and availed a loan in the name of the de-facto complainant. A1/de-facto complainant's husband bought a land and registered it in his name Instead of the husband of the de-facto complainant namely A1 obtained and registered the loan in his name and thereafter transferred by way of settlement deed.

6. Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel on either side, there are no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
