PRAYER:- Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus directing the 1st and 2nd respondents to take action against the 3rd and 4th respondents from establishing or running the restaurant or any other outlet with valet parking facility in the Industrial plot comprised in Survey No.38 part and 506 part of Mogappair Village, measuring about 9456 sq.ft. bearing plot No.G-9, 11th street, South Phase, Ambattur Industrial Estate, Ambattur, Chennai-600 058, pursuant to the letter dated 22.12.2021, in Rc.No.117/A8/2021, issued by the 2nd respondent. (The matter is heard through "Video-conferencing") The present Writ Petition is filed for a direction to the respondents 1 and 2 to take action against the respondents 3 and 4 from establishing or running the restaurant or any other outlet with valet parking facility in Industrial plot comprised in Survey No.38 part and 506 part of Mogappair Village, measuring about 9456 sq.ft. bearing plot No.G-9, 11th street, South Phase, Ambattur Industrial Estate, Ambattur, Chennai-600 058, pursuant to the letter dated 22.12.2021, in Rc.No.117/A8/2021, issued by the 2nd respondent.
2. Today, when the matter is taken up for hearing, the learned counsel appearing for the petitioner submitted that after filing the writ petition, the 2nd respondent has issued a letter addressing the issue of the petitioner and nothing survives in the petition and hence, seeks permission of this Court to withdraw this Writ Petition.
3. Recording the above submissions made by the learned counsel appearing for the petitioner, the Writ Petition is dismissed as withdrawn. No costs. Consequently, connected Miscellaneous Petition is closed.
