Claiming that the respondents are solely responsible for the death of her son, aged 8 years at the time of occurrence, who fell into the water sump maintained within the premises of the first respondent and died on 17.04.2011, the petitioner has filed this writ petition. However, when the writ petition was listed for hearing on 14.07.2021, there was no representation for the petitioner. the writ petition was listed on 22.07.2021, 26.07.2021 and 28.07.2021, but there was no representation for the petitioner. Even today, when the writ petition is listed under the caption 'for dismissal' there is no representation on behalf of the petitioner. The writ petition was filed in the year 2012 but the petitioner has not chosen to prosecute this writ petition. Therefore, the writ petition is dismissed for non-prosecution. No costs.
