2.Mr.L.A.J.Selvam, learned Government Advocate (Crl.Side) appeared for the first respondent. Names of R2 to R4 were printed in the Cause List. But there is no appearance.

3.Being satisfied with the reasons stated in the affidavit filed in support of the petition, the delay of 168 days in preferring the Crl.A. is condoned and accordingly, the petition is allowed.
