Respondents Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus pursuant to the 3rd Respondent's proceedings No.A2/18300/2007 dated 22.04.2008 containing proposal recommending Petitioner's son Mr.N.Raja for compassionate appointment against the vacancy of Night Watchman, addressed to 2nd Respondent herein, directing the Respondents to issue appointment order thereby providing with employment assistance on compassionate grounds, since the husband of the Petitioner late Mr.T.Nanjappa, died in harness. Petitioner has come up with the present Writ Petition seeking appointment for her son viz.N.Raja, on compassionate grounds.

Today, when the matter is taken up for hearing, learned Special Government Pleader appearing for the Respondents submitted that, the Petitioner's son was aged 24 years at the time of his father's death and that, the Petitioner filed the present Writ Petition after 10 years of her husband's death. He further submitted that, all necessary documents pertaining to the Petitioner's son have been forwarded to the Authority concerned to consider him for appointment to the post of 'Watchman' in the Respondent Department, on compassionate grounds.
Though there is enormous delay on the part of the Petitioner in seeking the relief of compassionate appointment for her son, as the Respondent/Department has taken a sympathetic view to recommend the Petitioner's son for employment, this Court directs the Respondents herein to consider the Petitioner's son viz. N.Raja for appointment on compassionate grounds as Class IV employee, within a period of two months from the date of receipt of a copy of this order, if he is otherwise found eligible, relaxing the age. This Writ Petition is disposed of accordingly. No costs.
