Having regard to the nature of the applications filed, the mother is keeping the children all along, despite the order of the Subordinate Court granting visitation right to the petitioner. Somehow or the other, the order has not been implemented. In such view of the matter, this Court is of the view that for healthy growth of the children, the affection of both parents are required. Therefore, the children cannot be used as a property of any one to settle the personal scores between husband and wife. Therefore, this Court is of the view that for healthy atmosphere for bringing up the children, the affection of the father is also very much needed. In such view of the matter, the father is entitled to visit the children atleast once in a week in the respondent's place for which the counsel appearing for the respondent has no objection.

Accordingly, the husband namely petitioner herein is entitled to visit the children in the respondent's house every Saturday and Sunday at 10.00 am and take the children and keep the children in the same place where the petitioner's http://www.judis.nic.in 1/2

house is also situated and leave the children back at 4.00 pm on the same day. It is also made clear that the father namely the petitioner shall not take the children outside the jurisdiction of Sivagaga and it also see to it that the children are not exposed to crowd and other areas during this pandemic situation. The petitioner shall also pay the school fees of the children without fail. Such arrangement shall continue until further orders.

Accordingly, the present application is disposed of. Post the main O.P., for trial before the learned Additional Master on 30.11.2020. 5.

In view of the order passed in this application, no further orders required in the other application in A.No.811 of 2020. Accordingly, this application is closed.
