The petitioner wife filed this Civil Miscellaneous Petition praying to extend the period of trial in O.P. No.3747 of 2018 and O.P.No.3331 of 2018 pending before the I Addl. Family Court, Chennai to conduct the proceedings for another period of three months. But, the fact reveals that respondent husband filed a petition for divorce and wife has filed a petition for restitution of conjugal rights and the same is pending from the year of 2018 onwards. In the meanwhile, though before the mediation counselling was given to the parties, settlement was not arrived between them.
2. Earlier, this Court by an order dated 03.02.2022 granted three months time to settle the issue, but till date, the matter was not settled. However, they have also filed a petition for mutual consent, as such, they have availed all sorts of remedies available under the Code of Civil Procedure. Now, P.W.1 was examined and chief-examination now starts. If at all, there is no possibility of settlement arrived between the parties in the 1\3
mediation. In the said circumstances, both parties are directed to cooperate for the trial proceedings and dispose all the cases pending between the parties within a period of two months without giving unnecessary adjournments from the date of receipt of copy of this order. Accordingly, this Civil Miscellaneous Petition is ordered. 30.03.2023 rpp 2\3
