JUDGMENT

This appeal is filed challenging an order passed by the trial Court in I.A.No.2 of 2021 in O.S.No.845 of 2021, which the appellant / plaintiff herein has filed for deposit of the original title deeds pertaining to suit 1/4

property into the Court.

2.Heard both sides.

3.The learned counsel for the appellant submitted that the plaintiff would be rest contented if the copies of the title documents to the suit property are provided to her.

4.The learned counsel for the respondent / 3rd defendant submits that he is right away handing over the copies of the title documents which he now has to the other side. This is recorded.

5.If any other document is required by the plaintiff, then she is required to take out such necessary application before the trial Court and not by way of a petition for mandatory injunction.

6.This Court is informed that the parties are senior citizens and some of 2/4

them are in their mid seventies. The trial Court is now required to include the case in the senior citizen cases and try to dispose of the matter preferably before summer vacation in 2024.

7.This Appeal stands disposed of accordingly. No costs. 27.11.2023 kas Index : Yes / No To.
