and reject the E-Form submitted with anomalies by the fifth respondent as unlawful.

ORDER

This writ petition is filed with a prayer to quash the impugned order dated 23.07.2025 and to conduct a proper enquiry, accept the E-form submitted by the Tamil Maanila Kattida Thozhilalar Sangam and reject the E-form submitted by the fifth respondent.

Upon hearing the learned counsel for the petitioner and perusing the material records of the case, it can be seen that there is a dispute between the present Treasurer, Mr.E.John, who represents the Tamil Maanila Kattida Thozhilalar Sangam and the fifth respondent, as well as one M.Subbu @ Subramani and other persons. It can also be seen that a civil suit has already been filed by the petitioner himself in O.S. No.3395 of 2022 on the file of the XVII Assistant City Civil Court, Chennai and the same is pending.

3. When the dispute is essentially as to who was properly elected and the matter is seized of by the Civil Court, instead of approaching this Court for the relief of recording the e-form, an interlocutory application can be filed before the same Court in which the dispute is pending. The Civil Court, upon

considering the prima facie case on behalf of the petitioner or the M.Subbu @ Subramani group, can issue interim directions to the statutory authorities to accept the e-form either filed by the plaintiff in the suit or the first defendant in the suit and accordingly the authorities shall abide by the same. Even otherwise, when the civil suit comes to an end pursuant to the decree, the authority shall register the e-forms, as per the decree.

4. With the said liberty reserved to the petitioner to move the Civil Court, this writ petition stands disposed of. Consequently, connected miscellaneous petition is also closed. No costs.
