Respondent(s) PRAYER; This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 1st and 2nd Respondents to consider and dispose the petitioners representation dated 30.06.2025 and by consequently on sympathetic grounds enhancing the Recruitment from 25 percentage to 50 percentage as cited Bihar Home Department par with Puducherry home Department and consider all eligible 2016 Batch Home Guards for upcoming vacancies of Police Constables in 2026 for absorption of Police Constables in the Police Department within the stipulated time as prescribed by this honle Court.

ORDER

This petition has been filed seeking a direction to the 1st and 2nd Respondents to consider and dispose the petitioners representation dated 30.06.2025 and by consequently on sympathetic grounds enhancing the Recruitment from 25 percentage to 50 percentage as cited Bihar Home

Department par with Puducherry home Department and consider all eligible 2016 Batch Home Guards for upcoming vacancies of Police Constables in 2026 for absorption of Police Constables in the Police Department within the stipulated time as prescribed by this honle Court.

2. It is the case of the petitioner that they were recruited and appointed as Home Guard on 18.07.2016 vide proceedings of the 3rd respondent dated 18.06.2016. After completion of basic training, the petitioners have been engaged in Police and Jail Department for routine day by day duties not only for security oriented duties, other office work. As per recruitment, their enrolment shall terminate on the expire of the period of three years but permitting to continue the post to till date of 10 years of service with the respondent. In the meanwhile, the 4th respondent has issued notification on 12.08.2025 inviting applications for direct recruit 100 male constables and 48 female constable total to 148 police constables. However, the petitioners have completed 10 years of service. Without absorbing the petitioners, the respondents have issued notification for fresh recruitment. Aggrieved over the same, the petitioners have made a representation on 30.06.2025 and the same has not been considered. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners

representation within the stipulated time as fixed by this Court.

4. The learned Additional Government Pleader appearing for the respondents submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the first and second respondents to consider and pass orders on the petitioner's representation dated 30.06.2025 within a period of four weeks from the date of receipt of a copy of this order.
