Heard Mr. K.Bratheesh, Learned Counsel for the Petitioner and Mrs. Geetha Thamaraiselvan, Learned Special Government Pleader, who takes notice for the First to Third Respondents, and perused the materials placed on record, apart from the pleadings of the parties. 2.
Having regard to the nature of order proposed to be passed in the Writ Petition, which would not cause any prejudice to the Fourth and Fifth Respondents, notice to them is dispensed with. 3.
It is the case of the Petitioner that resolution had been passed at the meeting of the general body of the Co-operative Society of the Salem Silk Society, S1227 for the removal of the Fourth and Fifth Respondents from its membership, but no further action had been taken thereof, in respect of which he had made a representation dated 18.10.2023, which has not evoked any 2/5
response, necessitating the filing of this Writ Petition. However, neither the said Co-operative Society has been made as a party to the Petitioner nor the copy of the resolution said to have been passed at the meeting of the general body of that Co-operative Society has been produced. In that backdrop, Learned Counsel for the Petitioner seeks permission of the Court to withdraw the Writ Petition with liberty to file fresh Writ Petition and implead the necessary parties and also produce relevant documents in support of this case and he has made an endorsement to that effect in the court record. In fine, the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
