CRIME NO.21 OF 2020.

Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition that the petitioner shall report before the Learned V Metropolitan Magistrate instead of the respondent police in Crl.OP.No.801/2021 order dated 21.01.2021.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.M.RAJENDIRAN, Advocate for the petitioner and of MR.T.SHUNMUGARAJESWARAN Govt. Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- This petition is filed to modify the condition in Crl.O.P.No.801 of 2021 dated 21.01.2021 directing the petitioner to report before the respondent police everyday at 5.30 p.m. until further orders.

2. The learned counsel for the petitioner would submit that as directed by this Court in this case, the petitioner is regularly appearing before the respondent everday at 5.30 p.m. However, since the petitioner is also appearing before the respondent everyday at 10.30 a.m. in connection with yet another case in Crime No.550 of 2020, he is unable to do any other work for his livelihood. Hence, he seeks for modification.

3.The learned Government Advocate appearing for the respondent would submit that the petitioner is regularly complying with the condition imposed by this Court in Crl.O.P.No.801 of 2021 dated 21.01.2021.

4.Considering the facts and circumstances of the case, the condition 5(c) imposed on the petitioner in Crl.O.P.No.801 of 2021 dated 21.01.2021, is modified to the effect that the petitioner shall report before the respondent police on the first Monday of every month at 10.30 a.m. until further orders.

5.This petition is ordered accordingly.
