PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Certiorarified Mandamus, calling for records of the first respondent in his proceedings Na.Ka.No.17870/E4 (1)/03 dated 19.1.2009 and quash the same and direct the first respondent to allow the petitioner to retire from service and also grant all consequential benefits.

This writ petition was admitted on 17.09.2009 and thereafter came up for hearing on 19.08.2021, when the petitioner was called absent. The matter was adjourned to 23.08.2021, when also the petitioner was called absent. Representing counsel had appeared on behalf of the petitioner on 24.08.2021 and sought an adjournment on behalf of the petitioner. On 07.09.2021, Mr.S.K.Bose, learned Standing Counsel appearing for the respondents had also ensured that the pleadings were completed. On 20.09.2021, the matter was adjourned to 21.09.2021, when the petitioner was called absent.

2. In view of the fact that there was almost continuous absence on behalf of the petitioner, the matter was directed to be listed 'for dismissal' today and is so listed. However, even today, there is no representation by or on behalf of the petitioner. Hence, this writ petition is dismissed for nonprosecution. No costs. Connected miscellaneous petition is closed.
