ORDER

This Criminal Original Petition has been filed to direct the second respondent not to harass the petitioner.

2. The learned counsel for the petitioner has received a summons dated 06.12.2019 in which C.No.101 of 2019 alone has been mentioned, but not even Crime Number is mentioned. He further submitted that after receipt of the said summons the petitioner herein has filed Crl.OP.No.33366 of 2019 seeking anticipatory bail before this Court and when the said petition came up for hearing on 12.12.2019, the respondent herein has informed the Court that on the basis of the complaint given by the defacto complainant, enquiry was conducted and the same was closed. Accordingly, the said petition was closed. But even now the second respondent is frequently calling the petition and harassing the petitioner.

3. The learned Additional Public Prosecutor has submitted that since the third respondent herein has lodged a complaint against the petitioner, only for enquiry purpose the petitioner was called and subsequently the said petition was closed and the petitioner was not subjected to any harassment.

4. If any complaint is received against the petitioner, the second respondent is directed to enquire the complainant with regard to the said complaint and if the enquiry reveals any cognizable offence, he has to register the case and proceed further and instead of that, he should not unnecessarily harass the petitioner.

5. With the aforesaid observations, this criminal original petition is disposed of.
