Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, forbearing the respondent, his men, agents, servants or anyone acting on his behalf from in any manner interfere with or disturb the peaceful prawn culture activity carried on by the petitioner in the immovable property owned by him situate in Survey No.93, 94/2, 94/3, 94/6, 94/7, 105, 107/1C, 107/2A, 107/4A in No.20, Agaram Village, Ponneri Taluk, Thiruvallur District except by due process of law.

O R D E R

The relief sought for in the present writ petition is to forbear the respondent, his men, agents, servants or anyone acting on his behalf from in any manner interfere with or disturb the peaceful prawn culture activity carried on by the petitioner in the immovable property owned by him situate in Survey No.93, 94/2, 94/3, 94/6, 94/7, 105, 107/1C, 107/2A and 107/4A in No.20, Agaram Village, Ponneri Taluk, Thiruvallur District except by due process of law.

2. There is no interim order granted in this writ petition and the writ petition is pending for about five years.

3. The learned counsel appearing on behalf of the petitioner states that the petitioner is continuing the prawn culture business.

4. It is needless to state that if the petitioner has continued his business in an illegal manner by obtaining proper permission/licence etc., from the Competent Authorities, then he is at liberty to continue the same. However, the Competent Authorities shall conduct an inspection in the manner known to law and if any illegality is identified, then appropriate action shall be taken in accordance with law.

5. With the abovesaid observations, the writ petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
