..Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records of Respondent No.2 in issuance of Tender notice dated 06.01.2021 in Ref.No.NIT.No.Projects/T.No.9/Desal Plant Thoothukudi/2020-21 and quash the conditions in Clause 4 of ITB, Volume-I and clause 3.2 in its entirety at Section III, Volume-1 and thereby permit participation of entities including those which have entered into Joint Venture or have consortium partners and any other entities.

ORDER

The learned counsel for the petitioner has made the following endorsement :- "We are withdrawing the petition seeking liberty to file a fresh writ petition"

He would submit that since in the affidavit filed in support of this writ petition, the petitioner did not mention the name of the person to whom, the impugned tender has been tailor-made. He seeks liberty of this Court to file a fresh writ petition mentioning the name of the person for whom, the tender has been tailor-made.

2. After recording the submission made by the learned counsel for the petitioner and also after recording the endorsement made by the learned counsel for the petitioner, this writ petition is disposed of. However, liberty is granted to the petitioner, if so advised to file a writ petition in accordance with law. No costs. Consequently, connected Miscellaneous Petitions are closed.
