ORDER

Relying on the Will dated 27.08.2004 bearing Document No.115/2004, the petitioner states that he purchased the property from the legatees under the Will or their legal heirs. Upon presenting the sale deed for registration, it is stated that the document has been kept pending. Hence this writ petition.

2. Learned counsel for the petitioner submits that the Will came into effect upon the death of the testatrix on 03.06.2009. In spite of producing such death certificate, he submits that the document has been kept pending.

3. Ms.Akila Rajendran, learned Government Advocate, accepts notice for all the respondents. She handed over written instructions to the effect that the death certificate has not been produced.

4. The petitioner has filed the death certificate of the testatrix. The said document reveals that the testatrix died on 03.06.2009. Consequently, the Will would have come into effect on 2/4

the said date.

5. Considering the above, this writ petition is disposed of on the following terms:

The registering officer shall take into consideration the death certificate and other documents submitted by the petitioner and either register the document or issue a speaking order of refusal or make a reference under Section 47A of the Indian Stamp Act, 1899, within thirty days from the date of receipt of a copy of this order.

There shall be no order as to costs.
