Both counsel present. It is represented that the respondent had died long back and steps had not been taken to implead her L.R's on record and proceed with the appeal.
2. Inasmuch as, no steps had been taken to implead the LRs of the deceased respondent on record and proceed with the appeal in accordance with law, there is no purpose in keeping this second appeal further pending.
3. Learned counsel appearing for the appellants has also made an endorsement that the Second Appeal may be dismissed as abated.
4.In the light of the above position, the second appeal is dismissed as abated.
No costs. Consequently, connected miscellaneous petition, if any, is closed.
