THE HONOURABLE MR.JUSTICE K.RAJASEKAR

1. Ramesh S/o. Rajenthiran, Niraimathi Salai, Kattukottagai, Malaikottalam, Kallakurichi District - 606 203.

1. The State rep byThe Inspector of Police, Sankarapuram Police Station, Kallakuruchi District. Crime No.586/2025.

Respondent(s) PRAYER To enlarge the petitioner on bail in the pending investigation in Cr.No.586 of 2025 on the file of the Inspector of Police, Sankarapuram Police Station, Kallakurichi District.

For Petitioner(s):

U.Kathiravan For Respondent(s):

Mr.A.Gopinath Government Advocate (Crl.Side)

ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.09.2025, for the offence punishable under Sections 8(c), 20(b)(ii)(c), 29(1) of

NDPS Act in Crime No.586 of 2025, registered on the file of the respondent, seeks bail.

2. This Court earlier considered the bail petition of the petitioner in Crl.O.P.No.32187 of 2025 dated 02.12.2025 and dismissed the same on the following reasons:

"5. I have gone through the FIR and other connected materials, which revealed that the petitioners, all three, were found with ganja in a lonely place near the forest and it is also stated that they all travelled together from Vijayawada to Kallakurichi and they were about to hand over the same to other accused. Further, investigation is still pending. Hence, I am not inclined to grant bail. As of today, there is prima facie material to show that the contraband that has been seized is a commercial quantity. Accordingly, this Criminal Original Petition is dismissed."

3. The learned counsel appearing for the petitioner raised the very same point that the recovery from the petitioner is 7.380 kgs of ganja, hence Section 37 of the NDPS Act is not applicable. Hence, he prayed for grant of bail to the petitioner.

4. Since the very same point has been answered by this Court in the earlier order, I am not inclined to reconsider the earlier order. Accordingly, this Criminal Original Petition is dismissed.
