O R D E R

The relief sought for in this writ petition is for a direction to direct the second respondent to fix the rent in respect of the portion occupied by the writ petitioner in G.88 (Godown) Koyambedu Market, Chennai 92 and consequently to permit the petitioner to continue with his vegetable selling business. https://hcservices.ecourts.gov.in/hcservices/

2. At the outset, the grounds raised in the present writ petition deserves no further adjudication on account of efflux of time. Fixation of rent is being done periodically, based on the market rate fixed. Thus, the present writ petition filed during the year 2004 for fixation of rent cannot be considered now, and the authorities competent are bound to fix the rent in accordance with the procedures and as per the regulations or rules in force.

3. This apart, the learned counsel for the petitioner is also unable to inform this court about the present status of the writ petitioner, whether he is continuing in the premises or not. However, subject to verification of the factual details, the authorities competent are empowered to initiate action in the manner known to law. The writ petition stands disposed of accordingly. No costs. Consequently, W.P.M.P.No.21959 of 2004 is closed.
