Prayer: Writ Petition filed under Article 226 of Constitution of India, for issuance of a Writ of Certiorarified Mandamus, calling for the records of the Planning/Building Permission order letter dated 06/01/2020 vide order W.D.C.No.T.P.PPA/WDC No.08/09239/2019 issued by the 2nd respondent herein and quash the same and consequently direct the 2nd respondent to reconsider the petitioner Planning/Building Permission application dated 19/12/2019 for the property situated at Block No.38, Flat No.38 D, Old No.AB -125, New No.AB - 126, 4th Avenue Shanthi Colony, Annanagar , Chennai 600 040. Today, when the matter is taken up for hearing, there is no representation on behalf of the petitioner. Earlier the petitioner has filed an appeal before the Housing and Urban Development Department, Secretariat, Chennai - 600 009. The Additional Secretary (Technical), Housing and Urban Development Department, Secretariat, Chennai - 600 009, has passed an order dated 24.01.2020 bearing Letter No.12104/UD-VI(2)/2018-2, wherein it has been stated as follows :

"6.With reference to the above appeal, a personal hearing was held on 09.01.2020. The appellant Thiru.L.B.Senthil Kumar and the objector Tmt.A.R.Sujatha along with their counsels, Th.N.Kishore Kumar, Tmt.A.K.Vidhya, Tmt.Kanimozhi and the officials of GCC were attended the hearing.

7.During the hearing the appellant has informed that the objector has also made some unauthorized structure in their premises. Further the appellant have also stated that there are more number of similar unauthorized structures in Shanthi Colony.

8.The Objector Tmt.Sujatha informed that the unauthorized temporary structure put up in her premises has been removed and the structure with GF + 2 Floors commercial hotel building has been put up by the appellant in the setback spaces of TNHB allotted Plot and it is fully unauthorized." 2.In view of the above, nothing survives for adjudication in the Writ Petition. Recording the same, this Writ Petition stands dismissed as infructuous. No costs.
