Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus calling for the records of the respondent in connection with the impugned order passed by him in Rc.No.A3/4079/2008 dated 28.07.2008 and Rc.A3/4079/2008 dated 30.07.2008 and quash the same and direct the respondent to superannuate the petitioner from service and grant him all consequential service and monetary benefits.

O R D E R

When the matter was taken up for consideration, the learned counsel for the petitioner, on instructions, submitted that subsequent to the filing of this writ petition, the respondent passed an order vide Proceedings in Rc. No.A3/4079/08, dated 06.08.2010, according sanction for the prosecution of the petitioner. Hence, the learned counsel sought permission of this Court to withdraw this writ petition with liberty to file a fresh writ petition to challenge the said order. An endorsement has also been made by the learned counsel to that effect.

2. In view of the submission and the endorsement so made by the learned counsel for the petitioner, liberty is granted and this writ petition is dismissed as withdrawn. No costs.
