O R D E R

This petition is filed seeking for a direction to the learned Principal District Munsif, Namakkal to dispose of I.No.5 of 2022 in O.S.No.291 of 2017 pending on the file of the learned Principal District Munisf Court, Namakkal.

2. When the matter was taken up for hearing, at the admission stage, this Court directed the learned Principal District Munsif, Namakkal to send a report as to the pendency of I.A.No.5 of 2022. The learned Principal District Munsif, Namakkal submitted a report stating that she sits once in a week, that is on every Friday as in-charge and I.A.No.5 of 2022 was taken up on the same date when it was filed and ultimately the petition is posted on 20th June 2023 for filing counter. Since the sitting is on every Friday, the delay occurred in disposal of this application.

3. It is submitted by the learned counsel for the petitioner on record that now regular Presiding Office has taken charge and the cases are being taken up every day.

4. Considering the circumstances, this Civil Revision Petition is disposed of with the following directions:

The learned Principal District Munsif, Namakkal is directed to fix a specific date for filing of counter by the respondents on 20.06.2023 and after filing of counter, the enquiry has to be taken up immediately and dispose of the application in I.A.No.5 of 2022 as expeditiously as possible, not later than two (2) months from the date of receipt of a copy of the order. No costs.
