PRAYER: Second Appeal has been filed under Section 100 of C.P.C., against the Judgment and decree dated 01.07.2005 made in A.S. No. 55 of 2004, on the file of Subordinate Court, Vellore in reversing the Judgment and decree dated 31.03.2004 made in O.S. No. 1252 of 1993 on the file of the Additional District Munsif Court, Vellore.

J U D G M E N T
The learned counsel for the appellant submitted that the appellant was died long back, even then the legal heirs of the sole appellant did not come forward to implead them as party to this appeal. It clearly shows that the legal heirs of the sole appellant do not have any interest to proceed further with this appeal.
2. Hence this Second Appeal is dismissed as abated. No costs.
