C.R.P.No. 779 of 2019 T.V.THAMILSELVI, J.

This Court, by an order dated 29.10.2021 directed the learned Addl. District Judge, (Fast Track Court), Arni, Tiruvannamalai District to dispose of the suit in O.S.No. 9 of 2017 within a period of six months from the date of receipt of a copy of that order. Since the said case could not be disposed of within the time stipulated by this court, the court below by letter dated 27.09.2022 sought for extension of time. Hence, the matter is listed before this court today.

2. Perused the records. Already this Court directed the learned trial judge to dispose the matter within six months, but so far, no progress before the trial court as submitted by both the learned counsel for petitioner and respondent. Issues are yet to be framed in the suit. But, on perusal of reply by the Bench Clerk of the concerned court, the case was wrongly adjourned as if there is a stay granted by this court. The conduct of the staff would clearly reflects that he worked with negligent. Hence, a warning is given to him that the same error should not be committed in future. Due to the error

committed by the Bench Clerk, learned trial judge could not comply with the order passed by this court and hence, she prayed to grant further time to dispose of the suit.

3. Considering the request of the Presiding Officer of the learned Addl. District Judge, Fast Track Court, Arni, this court is inclined to extend the time for the period of five months from the date of receipt of copy of this order to comply with the order of this court. However, time granted by this court will not be extended after five months. 13.10.2022 rpp
