Ms. No.918 dated 03.09.1989.

ORDER

The writ petition has been filed by R.Kanimozhi, wife of R.Chandrasekaran at the time when she was aged about 35 years, in the year 2009 seeking declaration declaring that the action of the first respondent in selecting and appointing the second respondent as Noon-Meal Organiser in the Centre at the Panchayat Union School at Kunniyur Rishivandhiyam Panchayat Union, Kallakurichi Taluk, Villupuram District is violative of Articles 14 and 16 of the Constitution and seeking a direction to the first respondent to appoint her as Noon-Meal Organiser at the centre as per the G.O. 2.The challenge made by the petitioner against the order of appointment given to the second respondent cannot be gone into due to the passage of time. Even if the matter is taken up for consideration, the petitioner, who is now over aged namely 45 years, is not entitled to get the benefit of appointment. 3.In view of the fact that the prayer in the writ petition has become infructuous, the writ petition is dismissed. No costs.
