Advocate (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 353, 506(1) of the Indian Penal Code and Section 24(1) of Cigarette and other Tobacco Products Act, 2003 in Cr.No.147 of 2021 on the file of the respondent police, seeks anticipatory bail. 2.

The case of the prosecution is that the petitioner along with other accused persons was found in illegal possession of 182 Kgs of banned tobacco products and also prevented the police from discharging their duties. Hence, the complaint. https://hcservices.ecourts.gov.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence prays for grant of anticipatory bail.

4.The learned Government Advocate (Crl.Side) submitted that it is alleged that during the relevant point of time the petitioner in the illegal possession of 182 kgs of banned tobacco products and that the investigation is pending. He would submit that other accused involved in this case is yet to be secured later and custodial interrogation is required in this case. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of this case and that the custodial interrogation is required in this case, this Court is not inclined to grant anticipatory bail to the petitioner.
