ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.12.2025, for the offences punishable under Sections331(1), 305 of BNS 2023 in Crime No.843 of 2025, registered on the file of the respondent, seeks bail.

2.The case of the prosecution is that the petitioner involved in house breaking and stolen 36 soverigns of gold and 500 grams of silver and a sum of Rs.1,00,000/- cash from the house of the defacto complainant. Hence this case.

3.The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He further submitted that he is in judicial custody from 02.12.2025 and he is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that only gold was recovered and 500 grams of silver and sum of Rs.1,00,00/- cash was not yet recovered. He further submitted that though final report was filed, the case was not taken on file and there are 22 previous cases pending against the petitioner. Hence opposed to grant bail to the petitioner.

Considering the facts of the case and though it is stated that final report was filed the case was not taken on file, 500 grams of silver and a sum of Rs.1,00,000/-cash was not yet recovered and there are 22 previous cases pending against the petitioner, this Court is of the view that if the petitioner is released on bail, he will indulge in similar type of activities in future, hence this Court is not inclined to grant bail to the petitioner. 7.
